‘Elikoon is an innovative initiative seeking to maximise the cultural experience through inspiring gatherings with artists, musicians, thinkers, scientists and writers.
At 'Elikoon we propose associate encounters for our community within designated spaces, with limited capacity and exclusive content, always with the possibility to meet the guests.
Additionally, we offer an annual open calendar for new proposals driven by our own associates.
Starting our project in Barcelona, with the intention of expanding this model to other cities.
We strike for getting people and organisations together who share cultural sensitivity, looking for like-minded people and after unique and direct interactions with the guests. We propose an annual subscription and payment-per-assistance for each of the encounters.

The Proposal system of 'Elikoon is driven by our community, where everyone can suggest a guest.
Through a vote system, our members can make a proposal possible as an 'Elikoon encounter.
Those proposals that receive enough votes, will be assessed to make the encounter possible.

Navigation through ‘Elikoon’s website and app gives visitors a user condition, through which those accept fully and without restrictions every disposition included within this Legal Notice, which may have modifications as we continue to evolve as a platform, as do the digital properties or any part within these.

All contents, within ‘Elikoon, including without limitation, any text, data, logos, graphics, photographies, images, animations, software, applications, forms, videos, music and other audiovisual contents to which users and members have access, are ‘Elikoon’s property, and are only available for the sole use of users under the condition that they will not impersonate, publish, transmit, edit, adapt or distribute any content without our prior written consent. The name ‘Elikoon, just as any other names associated, and any other commercial names, and logos that are shown both digitally and offline, are registered trademarks owned by the organisation.

Conditions of Access and Use
‘Elikoon organises and promotes safe and open interactions, where our members can express themselves freely. The creation of positive and inclusive spaces is our priority; meaning our conditions establish what we do and allow, as well as what we do not allow, both in our encounters as digitally. ‘Elikoon limits the use of some of the services used through their website to the previous completion of the respective form. The user grants their authenticity, identity and veracity of all the data communicated to ‘Elikoon and will be the only responsible for false declarations that they may make or cause. The user agrees to make rightful use of the contents and services offered by ‘Elikoon, and do not use them in any way for:
a) Share illegal content, against the law or public order. We do not allow any content that shows, represents or describes nudity (with the exception of paintings and/or sculptures by recognised artists), sexual acts, the offer of sexual services, sexual arousal and/or sexual objectification or any image that denigrates the human being in any aspect.
b) Illegal content or behaviour: we will not allow support or praise for terrorism, organised crime or hate groups. We also do not allow selling or offering firearms, drugs or offensive weapons. Any other illegal behaviour, communication or content in our events or digital spaces will also be pursued and reported by the organisation.
c) Introduce computer viruses into the network or carry out actions that may alter, damage, interrupt or generate errors or damage to electronic documents, data or physical and logical systems of 'Elikoon or associated third parties; as well as hindering other users' access to the website and its services through the massive use of computer resources through which 'Elikoon' provides its services.
d) Try to access the email accounts of other users or restricted areas of the computer systems of 'Elikoon' or third parties and, if necessary, extract information.
e) Violate the intellectual or industrial property rights, as well as violate the confidentiality of the information of 'Elikoon or third parties.
f) Impersonate the identity of another user, public administrations or a third party.
g) Reproduce, copy, distribute, make available or in any other way publicly communicate, transform or modify the contents, unless you have the authorization of the owner of the corresponding rights or this is legally permitted.
h) Collect data for advertising purposes and send advertising of any type and communications for sales or other commercial purposes, without prior request or consent.
Interaction Norms
We promote the european values recognised within the Charter of Fundamental Rights of the European Union.
We respect and promote the local and regional legislation on public cultural events and entertainment activities, as well as rights and obligations when it comes to promoters, artists and public. Ley 17/1997, de 4 de julio, de Espectáculos Públicos y Actividades Recreativas.
These guidelines are associated with our Conditions of Access and Use, and the terms and conditions of membership. Failure to comply with community guidelines may result in suspension or cancellation of membership, deactivation of your account, or other restrictions:
a) Intellectual property and data protection: Members are asked to ensure that they have the rights and consents (including intellectual property and third-party property rights) required to create content on our events and digital spaces, as well as the rights and consents to share content.
b) 'Elikoon requests that members ensure that the content produced, connections or conversations held do not damage or defame the image of 'Elikoon.
c) Hate speech, harassment and abuse are not allowed, nor are threats of violence, hateful, defamatory or derogatory words or speeches. We do not allow attacks or abuse based on race, ethnicity, national origin, sex, gender, age, gender identity, sexual orientation, religion, disability, or illness.
Membership
Memberships that connect culture, cultural exchange and intellectual curiosity. ‘Elikoon is a platform based in freedom, intellectual curiosity, respect, tolerance and cultural exchange. As such, any person of the public has the right to sign up as member and to a membership.
‘Elikoon reserves the right to create, suspend and cancel any member account, delete or modify content, features, functionalities or services available to registered members, at any moment at the discretion of ‘Elikoon and without prior notice to the affected member, as long as there is an existing reason in defence of the rightful use of the platform.
‘Elikoon reserves the right to accept or reject any membership application. Only those who can prove their identity and have a genuine interest in arts and cultures will be granted access to a membership.
Username and password are personal. Members will be responsible for the confidentiality and use of their name and password and all activities (including purchases) that will be made through their member account. Transfer or sale of members access is not permitted.
‘Elikoon is not responsible for any damage caused by the divulgation of username or password, or for the use of any part done by another party in the name or with the password of a member.
Proposals
‘Elikoon reserves the right to approve or reject any artist proposals based in our values and cultural objectives of the company and platform.
‘Elikoon assesses internally the viability of the project doing a economic and logistic study of the proposal. Viability will be calculated depending on costs and difficulty (proximity of the artist, status, high profile…) in relation to the interest shown by other members of the community and the required funding in order to carry out the event.
Our members’ privacy is very important to us, which is why we ask apart from those that have been authorised, to not take pictures of any members or guests without prior notice. Taking into consideration that in order to take pictures the guests’ permission will also be required, the specified indications will need to be followed on a case by case basis. In the same way, sharing images on social media is not permitted without the previous permission of ‘Elikoon.
Respecting our guests and assistants, we kindly ask our members and guests to keep their personal devices in silence or switched off. In the event of needing to make or take a call, we ask to do so outside of the venue or in the designated areas.
‘Elikoon grants our members to invite up to x1 additional person that isn’t member of the platform to the events. As such, we kindly ask our guests’ responsibility to ensure their plus one follows ‘Elikoon’s interaction norms.

Regarding the purposes of using cookies, the basis of legitimacy will be consent.
Access to Member Data
'Elikoon will not communicate or share your data to third parties, unless we have your consent for which, there is a legal obligation or another basis of legitimacy that protects us.
In order to fulfill the aforementioned purposes, 'Elikoon will allow access to member data to those companies associated with the platform. In general, these will be companies that offer services necessary to fulfill the purposes about which we have informed, and always within the framework of the corresponding data processor, and that correspond to the following categories:

In those services that require registration as a user or the use of passwords, the user will be responsible for maintaining the confidentiality of the password, as well as for all activities that take place while the session remains logged in. In the event of unauthorized use of your username and/or password, you must notify 'Elikoon as soon as possible.
Member Rights regarding the Management of Personal Data
a) Right to request access to the same personal data and know, therefore, whether how 'Elikoon processes your data and what this data is.
b) Right to request rectification of your data if it is inaccurate, incomplete or outdated.
c) Right to request the limitation of processing in certain circumstances, which will mean that we can temporarily limit processing or retain it beyond the necessary time.
d) Right to oppose the processing of your data, among other cases, when the processing is based on the legitimate interest of 'Elikoon.

‘Elikoon does not accept press in our events. The nature of such is private. Members will be held accountable for the implications of leaking or publishing comments, images or articles about ‘Elikoon, their members and guests without ‘Elikoon’s prior consent.
Summary
By accepting the Terms and Conditions, and Legal Notice - our members accept the transfer of image and distribution rights to 'Elikoon.
'Elikoon is protected by Ley Orgánica 1/1982, de 5 de mayo, on civil protection of the right to honour, personal and family privacy in the same image, accepting the conditions of use of the application, members assign the rights image and distribution, as well as the establishment of the conditions of its use, for which it will be governed by the following.
Stipulation
a) 'Elikoon reserves the right to take photographs of events that take place as part of its cultural agenda, in which members of the platform may appear.
b) 'Elikoon may reproduce and disseminate the images and video content of the members, or parts thereof, using all known technical means and supports, particularly the audiovisual and electronic supports relevant to the operation of the platform.
c) Members, by accepting the Terms and Conditions of Use, expressly authorize 'Elikoon to capture, reproduce and disseminate images and video content of their person to authorized media and supports.
d) 'Elikoon will use image and video content in which members may appear solely to promote its own platform, including in digital spaces and other media, as well as in online and offline advertising intended to promote the platform.
e) 'Elikoon will not sell any of the images to third parties nor obtain any type of financial benefit from the images of its members.
Rejection of the Image Rights and Distribution Policy
This policy aims to protect the rights and privacy of members while promoting culture and active participation in the ‘Elikoon community.
'Elikoon will respect members' preferences regarding image rights as long as it has been properly notified through established means.
In the event that a member does not wish to appear in the images, they will have to send an email to info@elikoon.com, as well as notify the person responsible for the event of this decision.

The Proposals' system is promoted by the members using the platform.
Any member can send a guest's proposal
'Elikoon will publish the proposal depending on the opportunity and alignment with the platform's values
The proposal will need 50 votes from the community in order to make it to the Agenda
During this process, 'Elikoon will contact the guest and assess feasibility
If feasible, the proposal will be announced as an encounter within the Agenda - specifying the required number of subscribers and price per subscription
On the contrary, if not feasible, the voting members will be notified. The proposal can be re-assessed after 6 months
The encounters within the 'Elikoon Agenda would have passed the Proposal phase.
'Elikoon opens the process of reservations with date and target attendance
Any member can reserve up to x2 subscriptions for the encounter. Reservations are free of charge
Once the encounter hits the target attendance, payments for the reservations are requested to the members
Once payments are completed, the subscription is confirmed
The members subscribed will receive all the information about the encounter over email

'Elikoon is a platform based in freedom, intellectual curiosity, respect, tolerance and cultural exchange. As such, any person from the public has the right to request a membership. We establish a trial period, and once finalised, our memberships are billed annually.
Every membership request is reviewed by the administration team and assessed in order to guarantee that 'Elikoon's values are aligned with the new member.
Through our Proposals section within the app, fill the proposal form. Once we've reviewed its content and the Agenda's possibilities we will get in touch.
Subscriptions can be cancelled with full refund within the first 24h after the payment has taken place.
After the 24h, refunds are subject to the waiting list within the encounter. If there is a waiting list, we will process your refund as soon as the subscription has been assigned to another member.
In exceptional circumstances, we will allow our members to hand over their subscription to a person within their closest circle, providing their details. To solve any issues related to your subscriptions or attendance, you can contact our team on info@elikoon.com
You can share all encounters and proposals through your social media channels when subscribing or voting within our platform. You can also share encounters and proposals you follow via your Profile.
